Terms of Service
These Terms of Service govern your access to and use of the ClaraReminds SMS reminder service, operated by Silvertouch Solutions Inc. ('ClaraReminds', 'we', 'us', or 'our'). By creating an account or using the ClaraReminds service, you agree to be bound by these Terms. If you do not agree, do not use the service.
ClaraReminds is an SMS-based reminder service that allows caregivers to schedule text message reminders for seniors and other individuals. The service sends reminders at scheduled times, accepts simple reply confirmations, and notifies caregivers when no reply is received within a configured window.
ClaraReminds is a reminder and notification tool only. It is not a medical device, a clinical service, an emergency response system, or a substitute for professional healthcare. In a medical emergency, contact 911 or your local emergency services immediately.
You must be at least 18 years of age to create a ClaraReminds account. By using the service, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding agreement. If you are using ClaraReminds on behalf of another person, you represent that you have the authority to do so and to bind them to these Terms.

By clicking 'Get Started', creating an account, or using any part of the ClaraReminds service, you confirm that you have read, understood, and agree to these Terms of Service and our Privacy Policy. These Terms form a legally binding agreement between you and Silvertouch Solutions Inc.
ClaraReminds relies on third-party telecommunications carriers and SMS delivery networks to transmit messages. We cannot guarantee uninterrupted or error-free delivery. Message delivery may be affected by:
A failed or delayed message does not confirm whether a recipient has or has not completed a task. ClaraReminds should not be used as the sole means of ensuring medication compliance or monitoring a recipient's health or safety.
When caregiver alerts are enabled on your plan, ClaraReminds will send you a follow-up notification if no qualifying reply is received within the configured time window. These alerts are designed to support caregiver awareness and are not a guarantee of compliance, health status, or emergency detection. ClaraReminds does not monitor recipients in real time and is not an emergency service.
ClaraReminds is offered on a monthly subscription basis. Current plan details, pricing, and reminder limits are described on the ClaraReminds website at clarareminds.com. Plans are subject to change with reasonable notice to existing subscribers.
You may cancel your ClaraReminds subscription at any time by contacting us at support@silvertouchsolutions.com. There are no long-term contracts or cancellation fees. Cancellation takes effect at the end of the current billing period. You will continue to have access to the service through the end of the period you have paid for.
Upon cancellation, your account and reminder data will be retained for 90 days to allow for reactivation, after which it will be deleted in accordance with our Privacy Policy.
You agree not to use ClaraReminds for any unlawful or prohibited purpose. Prohibited uses include:

To the maximum extent permitted by applicable law, Silvertouch Solutions Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of ClaraReminds, including but not limited to:
In jurisdictions that do not permit the exclusion of certain warranties or limitation of liability, our liability shall be limited to the greatest extent permitted by law. In no event shall our total liability to you exceed the total subscription fees paid by you in the three months preceding the claim.
ClaraReminds is provided 'as is' and 'as available' without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free from harmful components.
We may update these Terms of Service from time to time. If we make material changes, we will notify registered users by email at least 14 days before the changes take effect, and will post the updated Terms at clarareminds.com/terms with a revised effective date.
Your continued use of ClaraReminds after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must cancel your subscription before the changes take effect.
These Terms of Service are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute arising from or relating to these Terms or the ClaraReminds service shall first be submitted to good-faith negotiation by contacting us at support@silvertouchsolutions.com. If the dispute cannot be resolved informally within 30 days, it shall be submitted to the exclusive jurisdiction of the courts of the Province of Ontario.
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Silvertouch Solutions Inc. with respect to your use of ClaraReminds, and supersede all prior agreements or understandings, whether written or oral. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
